HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.838 of 2018 ORDER:

Aggrieved by the interim order of injunction granted by the trial Court and confirmed by the Appellate Court, the defendants in a suit for bare injunction have come up with the above revision.

2. Heard Mr. G.L. Nageswara Rao, learned counsel for the revision petitioners.

3. The suit was filed by the adoptive father of the 2nd defendant. He was none other than the own brother of the 1st defendant. The plaintiffs sought for a decree of injunction on the ground that there was an oral partition between the brothers way back in the year 1975.

4. The trial Court granted an injunction and the Appellate Court confirmed the same. As against the said orders, the defendants are before me.

5. It is seen from the concurrent orders of both the Courts below that they applied the parameters of prima facie case, balance of convenience and irreparable hardship. I find no material irregularity warranting interference in the concurrent findings of the Court below.

Hence, the Civil Revision Petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
