HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16706 of 2016 ORDER:

Vide present Criminal Petition, the petitioner/Accused No.3 seeks a direction thereby to relax the condition imposed by the learned Metropolitan Sessions Judge-cum-First Additional District and Sessions Judge, Visakhapatnam while granting bail vide order dated 4.7.2016 in Crl.M.P.No.1476 of 2016 which arose out of Crime No.51 of 2016 registered on the file of Station House Officer, Police Station, Arakuvalley, Visakhapatnam for the offences punishable under Section 20(b)(ii)(c) read with Section 8(c) of NDPS Act.

Heard learned Counsel appearing on behalf of the petitioner/Accused No.3 and learned Additional Public Prosecutor appearing on behalf of the respondent-State. Perused the material on record.

Keeping in view the averments made in the accompanying affidavit and submissions of learned Counsel appearing on either side, I hereby modify the order dated 4.7.2016 passed in Crl.M.P.No.1476 of 2016 and direct that the petitioner/Accused No.3 shall be released on bail on his furnishing personal bond for a sum of Rs.25,000/- with two sureties each for the like sum, of which, one surety shall be from Visakhapatnam, to the satisfaction of learned Judicial First Class Magistrate, Araku. The other

conditions imposed by the Court below in the order dated 4.7.2016 remain intact.

With the aforesaid modification of the order of the Court below, the Criminal Petition is allowed partly. Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. -------------------------------------------- JUSTICE SURESH KUMAR KAIT DATED 13th December, 2016.
