THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.24277 OF 2017 ORDER:

Petitioner is working as an Anganwadi Teacher. By the order impugned, she is placed under suspension. The order of suspension is based on the complaint of performance of duties and responsibilities as Anganwadi Teacher. The competent authority placed her services under suspension. It is not in dispute that the District Welfare Officer is competent to place the petitioner under suspension.

Learned counsel for the petitioner submits that the impugned order is not preceded by notice and apparently due to some political influence the said order was passed, whereas in the affidavit filed in support of the Writ Petition certain allegations are sought to be levelled against the local M.L.A. However, it is noticed from the pleadings and the cause title that the local M.L.A. is not arrayed as respondent. The order per se does not reflect any political interference. Furthermore, against the order passed by the District Welfare Officer, appeal lies to the District Collector and without availing the said remedy, this Writ Petition is filed. Having regard to the same, this Court is not inclined to entertain the Writ Petition, at this stage.

The Writ Petition is accordingly dismissed granting liberty to the petitioner to avail the remedy of appeal, if so advised. It is open to the petitioner to raise all contentions as available in law before the appellate authority. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
