THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 1952 of 2015 ORDER :

The petitioner, who is an accused in Crime No. 146 of 2014 of Peddavaduguru Police Station, Anantapur District, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 147, 148, 324, 332, 307 r/w Section 149 IPC; Section 3 of P.D.P.P. Act; and Section 3(1)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989. At the time when the matter is taken up for hearing, learned Public Prosecutor, on instructions, submits that the petitioner is not shown as an accused till date. In view of the representation made by the Public Prosecutor, the question of entertaining the present petition under Section 438 Cr.P.C. would not arise.

Accordingly, the Criminal Petition is dismissed as premature with a liberty to the petitioner to renew his request as and when there is an apprehension of arrest.
