THE HON'BLE DR JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1539 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, (Cr.P.C.), is filed by the petitioners/accused Nos.1 and 2, seeking to quash the proceedings against them in Crime No.674 of 2016 on the file of the Madhapur (Guttala) Police Station, Cyberabad registered for the offences under Sections 420, 506, 406 and 120-B of the Indian Penal Code and under Section 156(3) Cr.P.C.

Heard the learned counsel for the petitioners/accused Nos.1 and 2, learned Assistant Public Prosecutor representing the first respondent-State and perused the record.

Petitioners-accused Nos.1 and 2 are husband and wife. A-1 is the owner and A-2 is the GPA Holder. The dispute between the parties appears to be civil in nature. This Court, vide orders dated 30.01.2018 in Crl.P.No.926 of 2018, directed the Station House Officer, Madhapur (Guttala) Police Station, Cyberabad not to arrest the other accused i.e., accused Nos.3 to 7 pending investigation, complete the investigation and file charge sheet or final report, as the case may be.

Accordingly, the Station House Officer, Madhapur (Guttala) Police Station, Cyberabad, is directed not to arrest the petitioners/accused Nos.1 and 2 pending investigation; and, complete the investigation and file the charge sheet or final report, as the case may be.
