HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.2063 OF 2017 ORDER:

The writ petition is filed questioning the action of the 2nd respondent in attempting to demolish the Northern Eastern Side Compound Wall of the petitioner's property bearing H.No.1-2-50/1, Kalvakolanu Street, Amalapuram, East Godavari District, without giving any notice. Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration (A.P) and the Standing Counsel for the 2nd respondent-Municipality.

Learned Standing Counsel for the 2nd respondent-Municipality, on instructions, submits that there is no proposal to demolish any part of the petitioner's property. It is only the apprehension on the part of the petitioner. Learned counsel would also submit that if any demolition is required to be made, the same would be done after following the due process of law.

Recording the submission made by the learned Standing Counsel for the 2nd respondent-Municipality, the writ petition is closed. However, it is made clear that any interference with the property of the petitioner, the same shall be done after following the due process of law. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
