THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22047 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as fair price shop dealer of shop No.50 of Jalagurgam village, Peapully Mandal, Kurnool District on permanent basis. While so, on 18.03.2015, the 2nd respondent suspended the authorization of the petitioner based on certain allegations without conducting any enquiry. Against the same, the petitioner preferred an appeal before the 1st respondent on 28.04.2015 with a stay application, but 1st respondent did not pass any orders thereon. Therefore, the present writ petition is filed questioning the action of the 2nd respondent in suspending the petitioner's authorization.

When the authorization of the petitioner was temporarily suspended, the 2nd respondent ought to have issued a show cause notice, but no show cause notice appears to have been issued to the petitioner and no enquiry was conducted. In these circumstances, the 2nd respondent is directed to proceed with the enquiry in accordance with law and complete the enquiry and pass final order thereon, within a period of sixty days from the date of receipt of a copy of this order by duly following the principles of natural justice in the enquiry process. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed.
