THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26524 OF 2013 ORDER:
This writ petition is filed challenging the inaction of the respondents in considering the representation of the petitioner, dated 29.10.2010, for surveying and showing the boundaries of the land under G.O.Ms.No.57, dated 08.01.1951 and another representation dated 28.02.2011 for resumption of Government land from Company for distribution to the Birlagadda poor people, who are former employees of the Company.
Today, when the matter is taken up for consideration, there is no representation on behalf of the petitioner. It is the case of the petitioner that the land of an extent of Acs.7.07 guntas in Survey Nos.746/B1, 747/A1, 747/2A1, 747/2A3, 754/2A and 747/2B situated at Kallur Village and Mandal, Kurnool District, was assigned by the Government of Madras vide G.O.Ms.No.57, dated 08.01.1951 to M/s.Tungabhadra Industries Limited (under liquidation) for the purpose of construction of temple, godowns and residential quarters to the workers. The members of the petitioner Society came to the said Society as labourers in 1946 and worked in the factory since 1952-53. The company was closed in October, 1994 without any notice. The management agreed to give house sites to 418 members with each plot having 48 square yards. Accordingly, a layout was prepared. The left over 60 to 80 members formed the petitioner Society and requested the Government to allot the land. They submitted a representation to the District Collector on 28.02.2011 ventilating their grievance. When no
action was taken on the said representation, the present writ petition is filed.
In view of the above facts, this Court is not examining the merits of the case, but directs the first respondent to consider the representation of the petitioner, dated 28.02.2011 and pass appropriate orders thereon in accordance with law within a period of three months from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
