THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI A.S.Nos.1722 AND 1945 OF 2003 COMMON JUDGMENT:- (per Hon'ble Sri Justice K.C.Bhanu) These appeals, under Section 54 of the Land Acquisition Act, 1894, are filed challenging the order and decree, dated 09.7.2002, in O.P.Nos.138 of 1994 and 119 of 1994 respectively on the file of the Senior Civil Judge, Adoni, which were disposed of by way of a common order.
2. Learned counsel representing the learned Advocate General (Andhra Pradesh) for the appellant stated that the issue involved in these cases is squarely covered by the common judgment, dated 29.3.2007, in A.S.No.1585 of 2003 and batch of this Court wherein it is held as under:
"We accordingly set aside the awarding of additional market value and interest on the enhanced compensation from the date of taking possession i.e., 15.05.1986 and award additional market value on the enhanced compensation from the date of notification to the date of passing of award and interest at 9% p.a. from the date of issuance of notification for a period of one year and thereafter 15% p.a.
The appeals are allowed to the extent indicated above. There shall be no order as to costs."
3. Following the said judgment, these appeals are allowed. There shall be no order as to costs.
4. Miscellaneous Petitions, if any, pending in these appeals shall stand closed.
