ORDER
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.
2. As per the affidavit filed by the petitioner, he was appointed as fair price shop dealer of Akuledu Village, Singanamala Mandal, Annatapur District by the 3rd respondent vide proceedings dated 18.12.2007. On the basis of the report alleged to have been submitted by the 4th respondent, the 3rd respondent issued a show cause notice-cumsuspension order on 14.08.2014 framing three charges against the petitioner. The petitioner submitted his explanation on 22.08.2014 denying the charges, but no order has been passed. The petitioner filed W.P.No.24665 of 2014 and the same was disposed of on 27.08.2014 giving liberty to the 3rd respondent to pass final orders, but it appears that the 3rd respondent has not passed the final orders. However, the 3rd respondent issued a fresh show cause notice on 15.04.2015 basing on the report of the 4th respondent. The petitioner submitted his explanation on 15.04.2015 itself.
3. This Court is not in a position to know whether the 3rd respondent has disposed of the case pending before him after receipt of the explanation submitted by the petitioner on 15.04.2015.
4. In the circumstances, this Writ Petition is disposed of, directing the 3rd respondent to consider the explanation submitted by the petitioner and dispose of the case pending before him pursuant to the show cause notice dated
15.04.2015, in accordance with law after affording due opportunity to the petitioner, within a period of 30 days from the date of receipt of a copy of this order.
5. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________________ A. RAMALINGESWAR RAO, J 1st June, 2015 sj
