THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7220 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the office order No.E2/255(5)/2014-RMQ, dated 25-02-2016 of the 3rd respondent as arbitrary, unjust and contrary to the Circular No.PD-111/1977-78 dated 08-09-1977, in utter violation of principles of natural justice and APSRTC Employees' (CC&A) Regulations, 1967, discriminatory and in violation of Articles 14 and 21 of Constitution of India and set aside the same and consequently direct the respondents to retain the petitioner in Adoni Depot, duly drawing the salary for the period from 23-01-2016 to till date."

Heard, Sri A.G. Satyanarayana Rao, learned counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for respondents.

During the course of hearing, it is brought to the notice of this Court by learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner herein will make necessary application before the respondent authorities and the same may be directed to be disposed of by the respondents, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and this Court considers the said request as reasonable. Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without

expressing any opinion on the merits of the matter and entitlement of the petitioner, keeping it open for the petitioner herein to make necessary application to the respondents for redressal of his grievance within a period of one week from the date of receipt of a copy of this order and if any such representation is made within the time stipulated the same be considered and appropriate orders be passed by the respondents, in accordance with law, within a period of two (2) weeks thereafter.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
