THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION Nos.23210, 23211 AND 23212 OF 2017 COMMON ORDER:
Since the subject matter in all these writ petitions is one and the same, these writ petitions are disposed of by way of this common order.

The common grievance of the petitioners is to declare the action of the respondents in not permitting the petitioners to distribute the essential commodities to the ration card holders through their respective fair price shops, though the petitioners have valid authorization which is valid upto 31.03.2018 which is neither suspended nor cancelled as on date, as illegal, arbitrary and in violation of the principles of natural justice.

Heard the learned counsel for the petitioners and learned Government Pleader for Civil Supplies representing the respondents. Perused the prayers in the respective writ petitions with supporting affidavits and the other material on record.

As there is nothing to show any disciplinary proceedings initiated by the Revenue Divisional Officer as Competent Authority against the petitioners, much less pending, the
impugned action of the respondents in not supplying of provisions to the licensed dealers is unsustainable. 5.
Having regard to the above, all these writ petitions are allowed, directing to supply the provisions to the petitioners, for distribution of the same to the ration card holders. It is made clear that this order will no way interdict any required action, if at all, as per law only.

Miscellaneous petitions pending consideration, if any, in these cases shall stand closed in consequence. No order as to costs.
