The learned counsel for the appellants would submit that since the subject suit in O.S.No.667 of 2009 on the file of the Chief Judge, City Civil Court, Hyderabad, is dismissed for default, nothing survives for adjudication in this appeal, which is filed challenging an interlocutory order passed in the said suit. 2 .

Recording the said submission, this appeal is dismissed as infructuous. No costs.

Miscellaneous petitions, if any, pending in this appeal, shall stand closed.
