Y. Venkateshwara Rao Srinivas v. The State Of Telangana
HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.281 of 2019 ORDER :
Heard learned counsel for the petitioner and the learned Public Prosecutor, representing the State - respondent and perused the impugned order on 27.02.2019 in Crl.M.P.No.133 of 2019 that was modified by another order in Crl.M.P.No.3804 of 2018. The impugned order running in eight paras at para 4 speaks of the above original order granting bail. Petitioner filed petition to relax the condition of the deposit of Rs.10 lakhs in the form of F.D.R and he was directed to surrender before the Station House Officer on or before 28.12.2018, but he did not comply and violated the condition and is escaping the prosecution even by vacating the registry premises in seeking to cancel the bail by filing application on 11.01.2019. At this stage, accused/petitioner filed application in Crl.M.P.No.35 of 2019 for extension of time to surrender and the petition was dismissed on 21.02.2019 as not pressed, from hearing arguments in the petition for cancellation of bail sought.
2.
It is the submission in the petition that his marriage was performed on 28.12.2018 and because of that he could not surrender within the stipulated time.
3.
Taking into consideration of these facts, time for surrender before the Station House Officer is extended till 31.03.2019, failing which there is nothing to interfere with the impugned order of the lower Court.
4.
Accordingly, the revision is disposed of.
5.
Miscellaneous petitions pending, if any, shall stand closed. ____________________________ Dr. B. SIVA SANKARA RAO, J 26th March, 2019 Note:
