SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1559 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.4, in Sessions Case No.66 of 2017 on the file of the II Additional Metropolitan Sessions Judge, Hyderabad. The offences alleged are under Sections 147, 148, 120-B and 302 R/w.149 of I.P.C. and Section 25(1)(B) of the Arms Act, 1959. 2.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.
Learned Public Prosecutor, however, submits that there is no need to grant anticipatory bail to this petitioner since N.B.W. was issued against the petitioner and that he can seek for recall of the N.B.W. by filing appropriate petition before the concerned Court. 4.
Hence, the Criminal Petition is dismissed. However, the petitioner/accused No.4 is at liberty to file a petition before the concerned Court to recall the N.B.W. issued against him. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
