THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY CONTEMPT CASE No. 360 OF 2019 ORDER:

This Contempt Case is filed for alleging violation of orders dated 03.10.2018 passed by this Court in W.P.No.35653 of 2018. By the above said order, this Court directed respondent No.2 to verify the representation of the petitioner dated 16.04.2018 and take appropriate action for removal of encroachments in graveyard.

After receipt of the notices in the contempt case, the respondent No.2-Deputy Commissioner filed counter affidavit stating that the respondent corporation has considered the representation of the petitioner dated 16.04.2018 and pursuant to that the respondent corporation addressed a letter dated 22.12.2018 to the Tahasildar, Uppal Mandal, Malkajgiri District requesting for ground demarcation of Ac.0-27 Gts., Muslim graveyard land in Sy.No.230/3, situated at Nacharam Village, Uppal Mandal, Medchal-Malkajgiri District and to clarify whether any alternate land is allotted in lieu of the above said land for graveyard purpose. However, the Tahasildar has not sent any report as on the date of filing of the counter affidavit. Further, in paragraph No.7 of the counter affidavit, it has been

stated that there are several structures/habitations existing since long time in Sy.No.230/3 known as VST Colony. In the counter affidavit, the Commissioner also tendered unconditional apology for not filing of counter affidavit and non-compliance of the order as per the time stipulated by this Court. 3.

The unconditional apology tendered by the Deputy Commissioner is taken on record. Further, the Deputy Commissioner is directed to take appropriate action for removal of the encroachments, soon after receipt of the survey report/clarification letter by the Tahasildar. 4.

With the above observations, this Contempt Case is closed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this contempt case shall stand closed.
