HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5261 of 2019 ORDER:
The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not conducting the survey and fixation of boundaries in respect of the petitioner's land in Survey No.54/C1/A admeasuring Acs.3.14 guntas situated at Mansanpally Village, Peddemul Mandal, Vikarabad District, and not considering the application of the petitioner dated 15.12.
2018 through TS Online as being arbitrary, illegal, unreasonable and detrimental to the valuable rights of the petitioner guaranteed under Article 300A of the Constitution of India and issue a consequential direction directing the respondents to forthwith conduct the survey and fix the boundaries in respect of the above said land and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case." Perusal of the record reflects that the petitioner submitted a F-line petition in accordance with the prescribed format along with the requisite fee for survey and demarcation of boundaries in relation to the subject land.
Having received such an application, it is not open to the revenue authorities to remain somnolent.
The Writ Petition is accordingly disposed of directing the Tahsildar, Peddemul Mandal, Vikarabad Reddy District, to take appropriate action upon the petitioner's application in accordance with the due procedure expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
