THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1526 of 2004 ORDER:
Heard the learned Counsel for the petitioners, learned Counsel for respondent No.3, and the learned Government Pleader for respondent Nos.1, 2 and 4.
This Writ Petition was filed challenging the order passed by the Revenue Divisional Officer, Adilabad, dated 18.09.2003, directing the Mandal Revenue Officer, Bela, to handover possession of the land of an extent of Acs.6.35 guntas in Survey No.2 to the petitioner therein - Sri Qazi Nawabuddin, the third respondent herein, by conducting panchanama. Challenging the said order, the petitioners preferred an appeal before the fourth respondent on 22.12.2003, and the same is still pending. When no interim orders were passed suspending the order of the first respondent dated 18.09.2003, the petitioners approached this Court.
This Court, by order dated 29.01.2004, granted stay of dispossession initially, and the said order was made absolute by order dated 24.06.2004.
Learned Counsel for the petitioners raised various contentions touching the facts of the case and this Court is not inclined to examine those facts in view of the pendency of the appeal before the fourth respondent. However, the fourth respondent, before whom the appeal is pending, is directed to dispose of the same within a period of six months from the date of receipt of a copy of this order after observing the principles of natural justice, and in the meanwhile, the stay of dispossession, which has been continuing in the Writ Petition, shall continue till the disposal of the appeal by the fourth respondent. The Writ Petition is, accordingly, disposed of. The miscellaneous
