THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.300 of 2013 ORDER:

This petition is filed to withdraw Family Court O.P.No.138/2013 from District Judge, Medak at Sangareddy and transfer the same to Family Court, City Civil Court, Hyderabad.

Petitioner is wife and she filed her affidavit in support of the petition and according to her affidavit, her marriage was performed on 27-03-2008 at Ramachandrapuram, Medak District and due to harassment, she is now staying separately at her parents' house. She stated that she is depending on her parents and she cannot travel from Hyderabad to Sangareddy for each and every adjournment to defend O.P filed by husband for restitution of conjugal rights. She further contended that she got a three years old daughter and it is difficult for her to travel with baby for each and every adjournment. She contended that respondent husband is a resident of Ramachandrapuram and he cannot have any inconvenience, because Sangareddy Court or Hyderabad Court are at equal distance from the place of his residence i.e., Ramachndrapuram, which is at the outskirts of Hyderabad.

Other side has not filed any counter disputing the affidavit averments of the wife.

According to affidavit of the wife, she is residing at Khairatabad and it is difficult for her to travel from Hyderabad to Medak at Sangareddy for the purpose of defending the O.P.No.138/2013. Respondent/husband did not file any counter disputing the affidavit averments of the wife. Therefore, considering the affidavit of the wife and her convenience, O.P.No.138/2013 is withdrawn from District Court, Medak at Sangareddy and transferred to Family Court, Hyderabad for disposal in accordance with law. 5.

Accordingly, Tr.CMP is allowed and as a sequel, miscellaneous petitions, if any, pending in this Tr.CMP, shall stand disposed of. No costs.
