HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8984 of 2017 ORDER:

Heard learned counsel for the petitioners/accused Nos.1 & 2 of crime No.209 of 2017 of Nelakondapally Police Station, Khammam District, registered for the offences punishable under Sections 420 & 294(b) IPC and also learned Public Prosecutor representing the 1st respondent-State and before ordering notice to the 2nd respondent-defacto complainant and perused the grounds urged in the quash petition and the contents of the FIR. A perusal of the material on record no way entitles this Court to interdict the investigation, but for say pending investigation, the petitioners shall not be arrested, however it will not prevent the police to secure the presence of the accused for the purpose of the investigation.

Accordingly and in the result, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed.
