HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.4376 of 2018 ORDER:
Heard the learned counsel for petitioner and Sri N.Praveen Kumar, learned Standing Counsel for respondent No.2 Nagar Panchayat, and the learned Government Pleader for Panchayat Raj Rural Development (TG) and the learned Government Pleader for Industries & Commerce (TG) for the respondents 1 and 3 respectively and perused the prayer in the writ petition with supporting affidavit and other material on record. The prayer in the writ petition is as follows: " to issue a writ, order or direction more particularly in the nature of Writ of Mandamus declaring the impugned notice Lr.No.G1/ 227/ NPD/ 2018 dt. 12.01.2018 issued by respondent No.2 for payment of Rs.
2,46,88,378/ - as illegal and arbitrary and in violation of powers and functions conferred under the TS-iPASS Act, 2014 and the rules framed there under and consequently quash the impugned notice dt. 12.01.2018 issued by respondent No.2 as the said action of respondent No.2 is contrary to the procedure prescribed under the guidelines issued by respondent No.1 as specified in The Telangana Solar Power Policy 2015, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

It is the submission of the learned Standing Counsel for respondent No.2 Nagar Panchayat that as far as the impugned notice in Lr.No.G1/ 227/ NPD/ 2018 dated 12.01.2018 with a demand for Rs.2,46,88,378/ - is concerned, they are
Dr. SSRB, J W.P. No.4376 of 2018 withdrawing notice without prejudice to their right to issue a fresh notice with correct particulars.

Recording the above submission, this Writ Petition is disposed of. Further grievance of the petitioner, if at all, is left open when any such notice afresh received. No order as to costs.
Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
