THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION Nos.1375 and 1376 of 2022 COMMON ORDER:

These Criminal Petitions are filed under Section 451, 457 and 483 read with Section 482 of Cr.P.C. seeking a direction to the Inspector of Police, Humayun Nagar Police Station, to deposit two mobile phones i.e., Samsung S 20 and Samsung A 72 respectively, in the lower Court and the same may be released to the petitioners. 2.

Heard the learned counsel for the petitioners/A.3 and A.4 and the learned Public Prosecutor. Perused the record. 3.

According to the petitioners, in both the criminal petitions the Investigating Officer in Crime No.13 of 2022 of Humayun Nagar Police Station, seized the above two mobile phones and the same were not deposited before the learned XII Additional Chief Metropolitan Magistrate, Hyderabad. The petitioners have also filed appropriate petitions under Section 451 read with 457 Cr.P.C., vide S.R.No.82/1 and 83/1 respectively. The learned Magistrate has not numbered the said petitions and not disposed of in accordance with law. Therefore, the present petitions are filed.

A perusal of the remand report would reveal that the Investigating Officer in the above said crime has seized the above two mobile phones and they were not deposited before the learned Magistrate. Therefore, learned Magistrate has to dispose of the said petitions in accordance with law, if the same are in order.

Considering the said fact, the XII Additional Chief Metropolitan Magistrate, Hyderabad/concerned Court is directed to receive the petitions, number it if the same is otherwise in order, and dispose of the applications filed under Section 451 read with 457 Cr.P.C. on the very same day, in accordance with law. 6.
