HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33964 OF 2016 ORDER:

This writ petition is filed declaring the action of the respondents in interfering into the peaceful possession of the petitioner's possession of the petitioner's house at Thimmajiwadi Village, Sadasivnagar Mandal, Nizamabad District without passing orders in B/839/2016 issued by the 3rd respondent, as illegal and arbitrary. This Court on 29.09.2016 granted status quo order and also observed that the said order will not preclude the 3rd respondent from passing final orders after considering the explanation of the petitioner dated 17.08.2016. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Since it is stated that the petitioner has already submitted explanation on 17.08.2016 to the notice dated 08.08.2016 issued by the 3rd respondent, there shall be a direction to the competent authority to pass final order by taking into consideration the explanation filed by the petitioner, after giving an opportunity of hearing to the petitioner. Till then, status quo order passed by this court on 29.09.2016 shall continue.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
