Markapudi Veeraiah v. The Tahsildar
THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.22433 of 2015 O R D E R :
This Writ Petition is filed, challenging inaction on the part of the Respondent No.1, in rectifying the Revenue records and correcting the wrong entries in respect of the land to the extent of Ac. 4.19 cts in Sy.No. 184/1 of Tirumalagiri village, Jaggaiahpet Mandal, Krishna District, by including the name of the petitioner as owner and possessor by deleting the name of the respondent No.5 in the Revenue records.
2.
The petitioner states that his grandfather is owner of the land to an extent of Ac.11.02 cts, situated in Sy.No.184/1 of Tirumalagiri Village, Jaggaiahpet Mandal, Krishna District. It was assigned in his favour on certain conditions. His name has been entered into Revenue records. He got three daughters and the petitioner is son of one of the daughters. After the death of his grandfather, his three daughters partitioned the said land into three shares. Out of it, the mother of the petitioner has got share of the land to an extent of Ac.4.19 cts. The husband of the 5th respondent and his brother purchased land to an extent of Ac.3.67 cts in Sy.No.189/1 of Tirumalagiri Village, Jaggaiahpet Mandal, Krishna District under registered sale deed dated 28.12.1974. Though they purchased the land in Sy.No.189/1 from one Kastala Gnanamma, the authorities mutated the name of husband of the 5th respondent against the land in Sy. No. 184/1. Since, there is a wrong entry in the Revenue
records, by taking advantage of wrong entries, the 5th respondent is claiming title over the land belonging to the petitioner. In these circumstances, the petitioner filed the present Writ Petition seeking a direction to the 1st respondent to rectify the revenue records. 3.
A perusal of the papers filed along with the Writ Petition does not disclose any application filed by the petitioner for the relief sought by him in the present Writ Petition.
4.
In the circumstances, the Writ Petition is disposed of, giving liberty to the petitioner to file appropriate application under the provision of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act., within 30 days from the date of receipt of copy of this order and as and when such application is filed , the concerned authorities shall dispose of the same, after giving notices to all the effected parties, within in a period of three months from the date of receipt of such application, in accordance with the law. 5.
Accordingly, this Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
