HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5200 of 2019 ORDER:
The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in mutating the name of petitioner in respect of land admeasuring Ac.1.29 Gts out of Acs.3.18 Gts in Sy.No.239/A of Ugrawai Village, Kamareddy Mandal, Nizamabad District, as being illegal, arbitrary and violative of Articles 21 and 300A of the Constitution of India and consequently direct the respondents to mutate the name of the petitioner in respect of land admeasuring Ac.1.29 Gts out of Acs.3.18 Gts in Sy.No.
239/A of Ugrawai Village, Kamareddy Mandal, Nizamabad District, and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case." Perusal of the record reflects that the petitioner made an application in the prescribed format in Form VIA under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The endorsement made on the said application reflects that the office of the Tahsildar, Kamareddy Mandal, Kamareddy District, received the same on 20.9.2014.
Having received such an application, it is not open to the Tahsildar, Kamareddy Mandal, Kamareddy District, to remain somnolent.
The Writ Petition is accordingly disposed of directing the Tahsildar, Kamareddy Mandal, Kamareddy District, to take appropriate action upon the petitioner's application in Form VIA in accordance with the due procedure expeditiously and in any event,
SK, J WP.No.5200 of 2019 Dt:13.3.2019 not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
