HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.33580 OF 2012 ORDER:

Heard Sri K.S.Murthy, learned counsel for petitioner.

2. After arguing the matter for considerable time and in view of the stand taken by respondent No.2 in the counter affidavit, the learned counsel for petitioner does not press for the relief seriously. The learned counsel for petitioner requests the Court to permit the petitioner to workout the remedies without reference to this Writ Petition.

3. The petitioner has already filed a suit in O.S. No.603 of 2012 on the file of the Court of learned II Additional District Judge, Rangareddy District for specific performance of agreement of sale, on which reliance is placed. The petitioner has also filed a representation to respondent No.2.

4. Therefore, by leaving the available remedies open to the petitioner to work out, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed.
