HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5206 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not mutating/online and issuing pattadar past books and title deeds in the name of the petitioner the land in Sy.No.290 an extent of Acs.6.00 situated at Hayathnagar Bagath Village, Hayathnagar Mandal, Ranga Reddy District, as illegal, arbitrary, contrary to the provisions of Telangana Rights in land and pattadar pass book act and as well as the violation of the fundamental right guaranteed under the constitution of India consequently direct the respondent to mutate/online and issue the pattadar pass books and title deeds in the name of the petitioner in above said land and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioner made an application in the prescribed format in Form VIA under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The endorsement made on the said application reflects that the office of the Tahsildar, Hayathnagar Mandal, Rangareddy District, received the same on 30.8.2016.

Having received such an application, it is not open to the Tahsildar, Hayathnagar Mandal, Rangareddy District, to remain somnolent.

The Writ Petition is accordingly disposed of directing the Tahsildar, Hayathnagar Mandal, Rangareddy District, to take appropriate action upon the petitioner's application in Form VIA in accordance with the due procedure expeditiously and in any event,

SK, J WP.No.5206 of 2019 Dt:13.3.2019 not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
