THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8312 of 2016 ORDER:
Heard Mr. G. Tarun Reddy, learned counsel representing Ms.Rubaina S. Khatoon, learned counsel for the petitioners, and Mr. K. Ramakanth Reddy, learned Standing Counsel for the All India Council for Technical Education, New Delhi.
The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction and more particularly, one in the nature of Writ of Mandamus declaring the action of the 1st respondent in unilaterally removing/excluding the dual degree courses in Management - Master in Applied Management (MAM) and in setting up of an integrated 5 year course degree course in Management without providing for an exit option for the academic year 201617 as arbitrary, illegal, unconstitutional and in contravention of the regulations of the UGC and the regulations of the 2nd respondent University and set aside such action and consequently direct the 1st respondent to provide for an exit option in the integrated 5 year degree course in management for the academic year 2016-17 and pass such order or other orders as this Hon'ble Court deems fit and proper in the circumstances of the case."
As the representation dated 11.03.2016 made by the petitioners in relation to their prayer is still under consideration before the All India Council for Technical Education, New Delhi, this Court deems it unnecessary to entertain this writ petition at this stage for adjudication on merits. It is for the Council to consider the said application and take appropriate action in the matter in accordance with law. In the event the request made under the said representation is rejected, the reasons therefor shall be recorded and duly communicated to the petitioners. This entire exercise shall be completed expeditiously and in any event not later than six weeks from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of.
