The case of the petitioner is that petitioner had applied for the post of Sub-Inspector of Police and the required height for selection to the post of Sub-Inspector of Police is 152.5 cms. Though the height of the petitioner is 152.6 cms, the respondents while conducting Physical Measurements Test had erroneously recorded the height of the petitioner as 152.4 cms disqualifying the petitioner. In those set of circumstances, petitioner had submitted representation to the respondents on 28.02.2019 requesting the respondents to reconsider her case and measure the height of the petitioner once again. But so far, the respondents have not passed any orders on the said representation. Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents either to take action on the representation submitted by the petitioner or direct the respondents to re-measure the height of the petitioner. He further contends that in case, the height of the petitioner is found to be 152.6 cms, consider her case for appointment to the post of SubInspector of Police. Learned Standing counsel appearing for the 2nd respondent submits that petitioner's representation would be considered and appropriate orders would be passed. He further submits that respondents are conducting the re-measurement test to the candidates who have been disqualified marginally and the said re-measurement test is scheduled to be conducted on
28.03.2019 and the case of the petitioner also would be considered by considering her representation.
This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation of the petitioner and pass appropriate orders in accordance with law and if necessary conduct re-measurement test to the petitioner and pass appropriate orders.
Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
