HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13459 of 2005 ORDER:

In this writ petition, petitioner is challenging the order dated 30.12.2004 passed by the Additional Industrial Tribunalcum-Labour Court, Hyderabad, in M.P.No.80 of 1999, which was passed in favour of the second respondent. When the matter is taken up for hearing, it is noticed that since the petitioner failed to serve personal notice on the second respondent in pursuance to the conditional order passed by this Court on 30.12.2010, the writ petition against the second respondent was dismissed for default by giving effect to the order dated 30.12.2010. Petitioner has not taken any steps to see that the writ petition is restored against the second respondent.

Having regard to the fact that in the absence of second respondent, this Writ Petition cannot be adjudicated on merits, this Writ Petition is dismissed.

As a sequel, miscellaneous petitions pending in this writ petition, if any, shall stand closed. No orders as to costs. _______________________________ ABHINAND KUMAR SHAVILI, J 28.08.2019.
