ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in making in-charge arrangement in respect of fair price shop of Acchaiahpally Village, Mulugu Mandal, Medak District as illegal and arbitrary.

This Court by order, dated 17.2.2011, directed respondent No.4 to consider the petitioner's request for his continuance as fair price shop dealer if his renewal application was made within the prescribed time and the same has not been rejected so far.

Respondent No.4 was further directed to pass an appropriate order and communicate the same to the petitioner within two weeks from the date of receipt of the order.

At the hearing, Mr. T.Niranjan, learned counsel representing Mrs. D.Pramada, learned counsel for the petitioner, submitted that after the said order was passed, the respondents have suspended the petitioner's fair price shop authorisation and also rejected the application filed by him for renewal on the ground that he was involved in a criminal case registered as F.I.R.No.68 of 2010 for the offence punishable under Section-307 read with 34 IPC. Having regard to the above facts, learned counsel for the petitioner submitted no further adjudication of this Writ Petition is necessary.

In the light of the above, the Writ Petition is dismissed as infructuous.

As a sequel to dismissal of the Writ Petition, WPMP.No.2056 of 2011 shall stand dismissed as infructuous. ________________________________ JUSTICE C.V.NAGARJUNA REDDY 30th September 2015 DR
