ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.358 of 2025 of Chivvemla Police Station, Suryapet District, registered for the offences punishable under Sections 100, 108, 351 (3)(4), 61(1) and 49 r/w.3(5) of the BNS and Sections 175 (3) of BNSS.

The brief facts of the case are that, on 23.12.2025, the defacto complainant filed a private complaint before the concerned

Court stating that the petitioner/A-1 along with A-2 and A-3 harassed the deceased and fraudulently transferred the property of the deceased in the name of the petitioner and thereafter she committed suicide. Hence, he requested the Court for necessary action. On referring the same, Police after conducting investigation registered a case for the above offences.

Heard Sri Bala Krishna Mandapati, learned counsel appearing on behalf of the petitioner as well as Sri M.

Ramachandra Reddy, learned Additional Public Prosecutor for respondent -State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations. He further contended that to constitute the offence under Section 108 of BNS there is no such mens rea and there is no proximity of the time between the date of incident and the date of registration of the property. He also contended that the deceased is the daughter of the petitioner herein and there is no question of abutting the deceased for committing suicide. As such, prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioner stating that the allegations against the petitioner are serious in nature. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it is observed that the deceased is the daughter of the petitioner herein and the allegation against the petitioner is that the property of the deceased was fraudulently transferred in the name of the petitioner herein. Thereafter the deceased questioned the petitioner and the petitioner herein along with other accused abused her in filthy language and also stated her to go and die. Whereas between the date of incident of committing suicide by the deceased and also the date of alleged transfer of property in the name of the petitioner there is a delay of one year. Considering the facts and circumstances of the case and also the delay of incident, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Chivvemla Police Station, Suryapet District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.10,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
