HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5196 of 2019 ORDER:

The prayer of the petitioners in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of Respondent No.2 in not conducting the survey to identify and demarcate the boundaries in respect of the petitioners' land in Sy.No.39 admeasuring 3811.50 Sq Yds situated at Venkatapur Village, Nirmal Mandal, Nirmal District, as being illegal, arbitrary, unconstitutional and consequently, direct the Respondent No.2 to forthwith conduct a survey and demarcate the lands of the Petitioners and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case." Perusal of the record reflects that the petitioners submitted a F-line petition in accordance with the prescribed format along with the requisite fee for survey and demarcation of boundaries in relation to the subject land.

Having received such an application, it is not open to the revenue authorities to remain somnolent.

The Writ Petition is accordingly disposed of directing the Tahsildar, Nirmal Mandal, Nirmal District, to take appropriate action upon the petitioners' application in accordance with the due procedure expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
