THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No. 33054 OF 2015 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue Writ of Mandamus declaring the action of the respondents in not considering the representation of the petitioner dated 30.09.2015 for granting special mercy for Pin.07 Academic Year candidate on par with other academic years, as illegal and arbitrary, and consequently, to direct the respondents to allow the petitioner to appear for the examination of backlog subject in IVC 07 diploma course that was scheduled to be conducted from 28.10.2015 pursuant to his representation dated 30.09.2015." Heard Sri Kurra Srinivas, learned counsel for the petitioner, learned Government Pleader for Technical Education appearing for the 1st respondent and Sri P.V.S.S. Rama Rao, learned standing counsel for the 2nd respondent.

When the matter is called, it is represented by the learned counsel for the petitioner that for redressal of his grievance, the petitioner herein submitted a representation dated 30.09.2015 to the 2nd respondent and as no action has been taken on the said representation, appropriate direction can be issued to the 2nd respondent to take suitable action on the said representation by fixing some timeframe. This Court considered the said request as reasonable.

For the aforesaid reasons, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the 2nd respondent to pass appropriate orders on the representation dated 30.09.2015 submitted by the petitioner herein, in accordance with law, within a period of 15 days from the date of receipt of a copy of the order. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand dismissed.
