Mohammed Yousuf v. The State Of Telangana
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4789 OF 2018 ORDER:
This writ petition is filed challenging the action of the respondents in not entertaining the petition filed by the petitioners under Order I Rule 7 of the Code of Civil Procedure in the proceedings pending before the Revenue Divisional Officer, Ranga Reddy District, at Kandukur, in respect of the 'Occupancy Rights Certificate' claim made by the unofficial respondents. After hearing the learned counsel for the petitioners, it is pointed out by the learned counsel for the respondents 9 to 14 that as on today, no order was passed by the third respondent. In view of the same, the writ petition is premature and is accordingly dismissed. However, it is open to the petitioners to take appropriate proceedings in accordance with law as and when an order is passed by the competent authority.
Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 19.02.2018 pln
