Heard Mr.Dadi Radha Krishna, counsel for petitioner and the leaned Assistant Government Pleader for respondents 1 to 4.

The petitioner challenges the order of 4th respondent in Rc.B.No.186/2017 dated 02.01.2018, canceling the assignment of an extent of 20 x 20 sq.yards in Sy.No.393/B vide 147/2005 dated 08.05.2005, as illegal, arbitrary and without jurisdiction.

The Assistant Government Pleader objects to the maintainability of writ petition because the petitioner has affective alternate remedy of appeal before the 3rd respondent.

The petitioner is willing to avail remedy of appeal and seeks protection and preservation of property, pending further orders in this behalf.

The petitioner is given liberty to file appeal within four

(04) weeks from today. The respondents are directed to maintain status quo as regards possession and enjoyment of the subject matter of the litigation for a period of eight

(08) weeks. The petitioner can also obtain further orders from the appellate authority.

Writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
