THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5258 OF 2019 O R D E R :

The case of the petitioners is that in pursuance to the notification issued by the 2nd respondent vide Rc.No.89/Rect./Admin-1/2018 dated 31.05.2018 for the direct recruitment of Stipendiary Cadet Trainee (SCT), Sub Inspector of Police (Civil) SCT RSI (SARCPL), SCT RSI (TSSP), Station Fire Officer and Deputy Jailer and notification vide Rc.No.88/REct./Admin1/2018 dated 31.05.2018 for the direct recruitment of Stipendiary Cadet Trainee (SCT), Police Constable (Civil), SCT PC (AR), SCT PC (SAR CPL), SCT PC (TSSP), firemen and Warders, in Police Department and other Departments, petitioners have applied for the posts as per their eligibility. Though the heights of the petitioners are 169 cms, 168 cms, 168 cms, 168.3 cms, 167.9 cms and 168.

3 cms respectively, the respondents while conducting Physical Measurements Test had erroneously recorded the heights of the petitioners as 167.4 cms, 167.4 cms, 167.4 cms, 166.9 cms, 167.3 cms and 167.4 cms respectively disqualifying the petitioners. In those set of circumstances, petitioners have submitted representations to the respondents on 05.03.2019, 05.03.2019, 17.02.2019, 05.03.2019, 07.03.2019, 05.03.2019 respectively requesting the respondents to reconsider their cases and measure the heights of the petitioners once again. But so far, the respondents have not passed any orders on the said representations. Aggrieved by the same, the present writ petition is filed.

to take action on the representations submitted by the petitioners or direct the respondents to re-measure the heights of the petitioners. He further contends that in case, the heights of the petitioners satisfy the required height, their cases be considered for appointment to the posts they have applied for. Learned Standing counsel appearing for the 2nd respondent submits that the petitioners' representations would be considered and appropriate orders would be passed. He further submits that respondents are conducting the re-measurement test to the candidates who have been disqualified marginally and the said re-measurement test is scheduled to be conducted on 28.03.2019 and the cases of the petitioners also would be considered by considering their representations.

This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations of the petitioners and pass appropriate orders in accordance with law and if necessary conduct re-measurement test to the petitioners and pass appropriate orders.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
