O R D E R

The grievance of the petitioner is that the respondents 2 and 3 - police authorities, are not conducting investigation in Cr.No.62 of 2015 dated 28.05.2015, which was registered based on the complaint of the petitioner against M/s Sundaram Finance Company Ltd., and others for the offences punishable under Sections 420 read with 34 IPC. Learned Assistant Government Pleader for Home produced written instructions of Station House Officer, Pitlam, Pitlam Police Station, at Pitlam, Nizamabad District, dated 15.03.2019, wherein it is stated that the complaint of the petitioner was enquired into and it was found to be of civil in nature and the same was informed to the petitioner by issuing notice and final report was filed before the court of Judicial First class Magistrate at Banswada.

Learned Assistant Government Pleader for Home produced copy of the final report under Section 173 Cr.P.C. and the notice sent to the petitioner. Though notice is stated to have been sent to the petitioner, the copy of the notice does not bear the acknowledgement of the petitioner. In view of the same, the 3rd respondent is directed to serve a copy of the final report to the petitioner and file before the court concerned, if not already filed.

The petitioner is at liberty to avail alternative remedies available under law. The writ petition is accordingly disposed of. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
