THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5227 of 2019 O R D E R:

When the matter is taken up, it is submitted by the learned counsel for the petitioner as well as learned Government Pleader for Revenue for respondents that the issue raised in the present Writ Petition is squarely covered by the common order dated 28.02.2019 passed by this Court in Writ Petition Nos.3967, 3969 and 3693 of 2019. Relevant portion of the said order reads as under:

"Having regard to the admission of the respondents in the counter affidavit that the crucial aspect of consideration of objections as mandated in the Act, has not been adhered to, the declaration issued under Section 19 of the Act, vide notification dated 17.02.2019, is set aside, so far as the petitioners are concerned. However, it would be open for the respondents to take appropriate action, if necessary. Accordingly, the writ petition is allowed.

Following the aforesaid order and for the reasons stated therein, this Writ Petition is also allowed in terms thereof. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 14th March, 2019 sj
