This writ petition is filed assailing the action of the respondents in proposing to demolish the houses/properties of the petitioners bearing D.Nos.3/140, 3/72, 3/37, 3/150, 3/74, 3/133, 3-71, 3/135, 3/141, 3/107 and 3/84 respectively, situated at Meda Street, Kalyanadurgam, Anantapur District, without following due process of law. It is the case of the petitioners that they are absolute owners and possessors of the buildings bearing Nos. D.Nos.3/140, 3/72, 3/37, 3/150, 3/74, 3/133, 3-71, 3/135, 3/141, 3/107 and 3/84 respectively, situated at Meda Street, Kalyanadurgam, Anantapur District and that they are using the said buildings both for commercial as well as residential purposes for the last several decades. There is no dispute with regard to title and possession over the subject property from any corner. However, the respondents are trying to demolish the subject properties for road widening purpose, without following due process of law. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioners, learned Assistant Government Pleader for R & B for respondents 1 to 3 and Sri Md.Saleem, learned Standing Counsel for the 5th respondent.
Learned Assistant Government Pleader for R & B as well as learned Standing Counsel for 5th respondent submits that they will follow due process of law in taking action against the structures raised in the subject property.
In view of the same, the respondents are directed not to demolish the structures raised in the subject property without following due process of law.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand disposed of.
