THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.1594 OF 2018 ORDER:

This petition is filed by the petitioner-accused under Section Cr.P.C.

to quash the proceedings in C.C.No.327 of 2017 on the file of the XXV Special Magistrate, Hyderabad, which was taken cognizance of the offence punishable under Section 138 of the Negotiable Instruments Act.

Heard learned counsel for the petitioner-accused and perused the record.

Learned counsel for the petitioner would submit that the complaint was filed with false allegations. Having argued for some time, learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Petition.

As far as merits of the case are concerned, there are no grounds to quash the proceedings. However, in view of the permission sought for by the petitioner to withdraw the petition, the Criminal Petition is dismissed as withdrawn. Miscellaneous petitions, if any pending in this petition shall stand closed.
