THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5365 of 2020 ORDER:
In this Writ Petition, it is the case of petitioner that respondent No.3 - Deputy Commissioner, Rajendernagar CircleXI, Greater Hyderabad Municipal Corporation, Rajendernagar, Ranga Reddy District, issued a show cause notice dated 27.02.2020 to him stating that his running of establishment under the name and style of DPC Transport Agency in the subject premises is illegal and dumping of waste and burning of it on the road is creating health hazards to the surrounding residents, for which, he submitted explanation on 28.02.2020 and 07.03.2020 stating that there is no business activity being carried out in the subject premises and it is being used as a cloth godown and for residential purpose of staff only. His grievance is that as on date, no orders have been passed by respondent No.
3 and that the respondent authorities are threatening to demolish his premises. Sri N. Ashok Kumar, learned Standing Counsel for Greater Hyderabad Municipal Corporation, appearing for respondent Nos.2 and 3, while refuting the allegations of the petitioner, would submit that pursuant to their verification, respondent No.3 issued the show cause notice dated 27.02.
CKR, J W.P.No.5365 of 2020 that PIL.No.398 of 2012 is pending before this Court and that as the petitioner has already submitted explanation, respondent No.3 would consider the same and pass appropriate orders in accordance with law.
In the light of the above, this Writ Petition is closed, by making it clear that without considering the explanation submitted by the petitioner and without passing orders as mandated in law, no coercive action shall be taken in respect of the petitioner's property.
Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
