THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12270 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declaring inaction on the part of respondent authorities particularly 2 to 5th respondents herein not considering the petitioners association representation dt:18.3.2016 by seeking the permission & Police aid /protection, to conduct the Dr. B.R.Ambedkar 125th jayanthi celebrations smoothly on 14.4.2016. at Ambdakar Statue near R.T.

C Bus stand Tirupati Town, as been illegal arbitrary unjust and violation of Article 19 & 21 of the Constitution of India and consequently direct the respondent herein particularly 2 to 5th respondents herein forthwith grant the permission, police aid/ proction pursent to the petitioner association representation dated 18-3-2016, to conduct the Dr. B.R.Ambedkar 125th jayanthi celebrations smoothly on 14.4.2016. at Ambdakar Statue near R.T.C. Bus stand Tirupati Town, and to grant such other relief of reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Assistant Government Pleader for Home placed before the Court the written instructions dated 12.04.2016 furnished by the Sub-Divisional Police Officer, Tirupati East, Tirupati Urban Police District, wherein it is stated that the two rival groups, one headed by P. Paramasivam, the petitioner herein, and the other headed by P. Chengalrayulu, are fighting over the holding of a programme at the Ambedkar statue on his birth anniversary, which falls on 14.04.2016. The Sub-Divisional Police Officer further stated that the steps taken for counseling both the parties came to naught but the feasibility of permitting different timings for the two groups was

still being considered.

Sri Palle Nageswar Rao, learned counsel for the petitioner, would assert that his client would willingly accept whatever timing is allotted to their group by the police authorities. The afore-stated stand of the petitioner is duly taken on record. In the light thereof, the respondent police authorities shall consider the applications of the two groups for permitting them to hold the celebrations at different timings near the Ambedkar statue located at the RTC Bus Stand, Tirupati Town, duly taking into consideration the law and order situation and other relevant factors.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
