SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1592 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is A-2 in P.C.O.R.No.4 of 2018 on the file of the Station House Officer, P.S. Jadcherla, Mahabubnagar District. The offence alleged is under Section 8(c) read with Section 22 of NDPS Act, 1985.
Heard the learned counsel for the petitioner-A2, learned Public Prosecutor appearing for the respondent-State, and perused the record.
The case of the prosecution is that A-1 was found to be in possession of 50 grams of Alphozam and made a confession stating that he purchased the same from A-2, the petitioner herein. Counsel for the petitioner submits that only to implicate A-2 in the crime, A-1 made such confession.
However, considering the facts and circumstances and nature of allegations, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner-A2 can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner on merits and in accordance with law, on the same day subject to the regular pressure of work. With the above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed.
