This Writ Petition is filed to declare the action of the respondent - Municipality in demolishing the small houses of the petitioners in an extent of 85 sq. yards each in Plot Nos.43, 3, 4, 25, 23, admeasuring 133.33 sq. yards in Plot Nos.94, 96, 97, 98 and 95 and admeasuring 133 sq. yards each respectively in Survey Nos.707/2, 707/3, 708/2 and 708/3, situated at Garmilla village, Mancherial Mandal, Adilabad district, without issuing any notice and opportunity, as illegal and arbitrary. This Court, while ordering notice before admission on 31.12.2013, ordered to maintain status quo.

The main grievance of the petitioners is that without issuing any notice and without following the procedure as contemplated under law the respondent authorities are trying to demolish their houses. Having regard to the facts and circumstances of the case, the respondent - Municipality is directed to follow due process of law before demolishing the houses of the petitioners.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
