This petition is filed by the petitioner-accused No.2 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in S.C.No.14 of 2016 on the file of the I Additional Sessions Judge, East Godavari District.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 8(c ) r/w 20(b)(ii)(c) of NDPS Act. It is alleged that 316 kgs of ganja was found in the vehicle, in which the petitioner and another accused were travelling. Learned Counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution and that he is the driver of the vehicle and he took the loaded vehicle at the instructions of his owner and he did not verify the goods and that he was arrested on 21.9.2015 and since then, he has been in prison. Learned Additional Public Prosecutor opposed this petition on the ground of commercial quantity of ganja seized from the possession of the petitioner.
