Heard.
2. The case of the petitioner is that he purchased the land admeasuring Ac.1-50 in Survey No.377/A of Ponnetipalem Gram Panchayat and Village in Madanapalle Revenue Mandal, Chittoor District, for valuable consideration under registered sale deed dated 10.07.1991 from one Narsamma and since then he is in peaceful possession and enjoyment of the same. While so, the respondents are acquiring the land of the petitioner in the said survey number without issuing any notice and without following the due procedure under law. Thereby, petitioner issued legal notice dated 17.07.2016 to the third respondent. Since there is no response from the third respondent, petitioner has approached this court by this writ petition.
3. Considering the facts and circumstances of the case, I deem it appropriate to dispose of the writ petition directing the respondents not to interfere with the petitioner's land without following due procedure under law. However, it is made clear that for the purpose of survey of the land in terms of Section 12 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the respondentauthorities are entitled to take necessary steps.
4. With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
