HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.1713 OF 2020 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in D.V.C.No.134 of 2017 on the file of the Additional Judicial Magistrate of First Class at Karimnagar.

A charge sheet came to be filed against the petitioners 1 to 6 for the offence punishable under Section 12 of the Protection of Women from Domestic Violence Act, 2005.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners 1 to 6 restricts his prayer seeking dispensation of the presence of the petitioners 2 to 6 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners 2 to 6 is not in dispute, their presence in the above case may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioners 2 to 6 is concerned in D.V.C.No.134 of 2017 on the file of the Additional Judicial Magistrate of First Class at Karimnagar, is hereby dispensed with except on the dates when their presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of insofar as the petitioners 2 to 6 are concerned. Insofar as the first petitioner is concerned, the Criminal Petition is dismissed. Miscellaneous applications, if any, pending shall stand closed.
