THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.16962 OF 2016 ORDER:
This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in C.C.No.97 of 2016 on the file of I Additional Junior Civil Judge, Narasaraopet, Guntur District.
During hearing, learned counsel for the petitioners urged to decide the matter at the earliest possible time, mainly on the ground that the second respondent having filed complaint is not appearing before the Court for the last six adjournments. Whereas, the petitioners are being put to harassment and attending the Court proceedings on every dates of adjournment. Expeditious disposal is a fundament right under Article 21 of the Constitution of India and undue delay caused on account of the second respondent herein/complainant may often lead to serious consequences and on account of pendency of the criminal case and frequent adjournments, certainly the petitioners are put to lot of inconvenience, which cannot be compensated by granting damages.
Therefore, the I Additional Junior Civil Judge, Narasaraopet is directed to decide C.C.No.97 of 2016, as expeditiously as
possible and in any event not later than three months time from the date of receipt of copy of this order.
With the above direction, criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Petition shall stand closed. No costs.
