THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34258 of 2017 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents. It is the case of the petitioner that the respondents inspected the house bearing D.No.6/194-1, Mulabata Street of Mydukur Town, and seized 104.16 quintals of rice on the allegation that the said rice is PDS rice. Now proceedings under Section 6A of the Essential Commodities Act are taken up and the same are pending. The petitioner filed a petition on 14.09.2017 for release of the said stock. When the second respondent passed an order on 19.09.2017 directing the third respondent to dispose of the seized stock pending final orders, the present Writ Petition is filed seeking a direction to the respondents to release the seized stock.

Learned Counsel for the petitioner submits that the petitioner is willing to furnish the bank guarantee for the value of the seized stock.

In the circumstances, the Writ Petition is disposed of directing the respondent Nos.2 and 3 to release the seized stock on condition of the petitioner furnishing the bank guarantee for the value of the seized stock if the stock was not already handed over to the Fair Price Shop dealer pursuant to the order dated 19.09.2017. It is open to them to take samples of stock for the

purpose of pending proceedings. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
